Boy shoots through window and kills friend who was trying to wake him

A boy who heard the sound of pebbles hitting his window grabbed and gun and opened fire – killing a friend who was trying to wake him up.

The victim, named as 15-year-old Mackeon Schulte by police, had been at a sleepover with friend in Billings, Montana, when the pair decided to go to another friend’s house and wake him at around 2.30am on Sunday.

But when that friend heard knocking on the door and pebbles hitting his window, he grabbed a revolver and fired through the window, hitting Mackeon in the head.

He died in hospital. The friend with Mackeon was not injured.

‘When their friend awoke, he was startled by the noise and saw faces outside the window,’ Billings Police Chief Rich St. John said in a statement.

‘He didn’t know who they were and was scared.’

The family of Mackeon is due to meet with police before a decision is made on whether to rule the shooting as a homicide.

Question: Homicide or tragic accident?
 
Shouldn't he have at least waited until he was immediate danger before opening fire?

I mean, I don't murder people when I hear a noise or see people outside.
 
To quote SmartGunLaws.org, "Minimum Age for Gun Possession: Federal law prohibits, with certain exceptions*, the possession of a handgun or handgun ammunition by any person under the age of 18.11 Federal law provides no minimum age for the possession of long guns or long gun ammunition."

I assume a revolver is classified as a handgun.

Now, to quote Heavy.com, "His friend, 17, hasn’t been named yet by police and no charges have been filed."

Surely they could at least charge him for illegal possession/use of a firearm.

Flat out homicide. You can not legally shoot someone outside your home. You can, however, shoot someone inside your home when you feel your life is in danger.

So would that technically mean that if someone were pointing a gun at you through the window, you couldn't shoot them first? Or is there a contingency for that sort of thing?

Not really. If I am in my home and a person is trying to kick in the door from outside I have every right to shoot through that door and kill him. But that could be different in other states. Like in California you probably have to wait until after they break in and just before the moment of being killed they can now defend themselves. :) But this sounds like the kid over reacted and should face some kind of punishment but not homicide.
