Justice served as she had no leg to stand on using the stand your ground law. She left, went in to the garage. That put her out of harms way. She then went back in and got her gun. That negated the stand your ground law. I still think 20 years is harsh since she didn't actually shoot anyone.

Florida's laws on guns are very harsh. I think we have something called the 10-20-life law that makes the sentence mandatory depending on the type of crime involving a gun is done.

http://www.dc.state.fl.us/oth/10-20-life/index.html You can go there for more info on the 10-20-life law.

The law forced the judge to carry out that sentence. There is no room for leeway as that is the least amount of time he can give you for firing a gun in the state of Florida.

Thank you for the link and the information. Glad I don't live in Florida! To clarify: I don't shoot people, I shoot at targets.

Now, if someone breaks in your house then Jazzy-po0h, by all means shoot the prick, I'm sure the cops wont arrest you because you shot a criminal in your house, they'd be more asking if you are ok then charging you, at least that's wishful thinking, am I right?

You are correct that if someone breaks into my home, I have the right to shoot to protect myself. I wouldn't, however, aim to kill. I would aim to lame and then wait for the cops. That is unless the other person had a firearm at which point I would shoot to kill.

Florida has castle doctrine laws which allows you to shoot anyone who breaks into your home and the person who you shot that broke into your home can't sue you for civil damages. Without castle doctrine laws, the thief you injured could turn around and sue you for his injuries and win even if he got them from breaking into your home. Not all states have those laws in effect though.

No offense to people here that live in Florida, but I would not want to move there. I'm surprised more people there aren't using castle doctrine laws as an excuse to commit murder. This woman, as a case in point, could have just said he broke in and she shot him. Instead she went with the Stand Your Ground law which she had no leg to stand on winning that one. *Heck, if she's going to spend 20 years in jail for just firing a warning shot, she might as well have shot him *being sarcastic*
