McDonald's must pay obese employee $17.5K

SAO PAULO – A Brazilian court ruled this week that McDonald's must pay a former franchise manager $17,500 because he gained 65 pounds (30 kilograms) while working there for a dozen years.



The 32-year-old man said he felt forced to sample the food each day to ensure quality standards remained high, because McDonald's hired mystery clients to randomly visit restaurants and report on the food, service and cleanliness.



The man also said the company offered free lunches to employees, adding to his caloric intake while on the job. His identity was not released.



The ruling was signed Tuesday by Judge Joao Ghisleni Filho in Porto Alegre.



Ghisleni said McDonald's could appeal the case, and the Brazilian headquarters of the chain said in an e-mailed statement Thursday it was weighing its legal options.



McDonald's also noted that it offers healthier food choices.



The chain offers a large variety of options and balanced menus to cater (to) the daily dietary needs of its employees, the company said in the statement.



McDonald's headquarters is in Oak Brook, Illinois.

Gosh, that's crazy in every way. I did mystery shopping in college and Mc'D's was one of my regular assignments. I finally told the company I didn't want to do fast food shops anymore because I was sick of eating it. Easy enough, they assigned me to retail shops. Choices - we all have them and he did too.



I also can't see how he felt obliged to test everything. Perhaps I can see that in small quantities, but that huge weight gain suggests otherwise. I think he's using it as an excuse. Also, he could have worked it off with daily exercise and avoided the weight gain.



This case reeks of another junk lawsuit jamming up the court system. pffffft

As you said Cinnamon we have choices and McDonalds do have healthier choices

My Daughter works in a McDonalds and has not put on any weight she has to get the bus to work though and only works part time

she is still in school and she walks there and back 5 days a week which helps keep the weight off

Plus she does PE in school ,

This man could have exercise to keep the weight off and eaten the heather food they offer

Exactly!! I also applaud your daughter for working while in school. That's tough, but she's already learning lessons about being self-supporting and responsible. Very good.

Okay so after working there for a dozen years, he gained 65 pounds and now wants McDonald's to pay him $17,500. He wasn't forced by McDonalds to sample food each day nor was he forced to eat the free lunches. He obviously chose to stuff his face with this unhealthy food. No one held a gun to his head or force fed him. Hell, this opens up an avenue for all obese people to blame McDonald's for their weight problem. Come on and give me a break here!
