Biological parenthood & custody?

Should judges be allowed to take into account whether or not a parent is biologically related to a child when making decisions in a custody hearing?



The court’s priority should be the welfare of the child and biological parenthood is irrelevant here. When making decisions, courts should focus on what is best for the child and his or her future development. Judges should take into account each adult’s capacity to provide care, their relationship with the child, their lifestyle and their motivations.

Biological parenthood...yeah all that means is that these two people made a baby. Doesn't mean that they're automatically willingly to provide for the baby in any way. It's not the only thing that should be considered, and although it is of some importance, other things have to be taken into account. Just because you give birth doesn't mean you are capable of doing any more.

If someone is proven time and time again to be an unfit neglectful or abusive parent then custody should be awarded to the child's grandparents or aunts and uncles or some other responsible person in their family. Maybe even put up for adoption. But be offered supervised visitation if they are so unfit and unstable.



However, if the above isnt the case, taking custody away from a parent is cold hearted and callous.
