CHP officer in highway beating could face "serious charges"

A California Highway Patrol officer who was videotaped repeatedly striking a woman on the side of a Los Angeles freeway could face "potentially serious charges," the agency said Wednesday after forwarding its investigation to the district attorney.

Officer Daniel Andrew, who was given a desk assignment after the incident, was removed from duty and put on paid administrative leave, the CHP said. The agency didn't reveal if it made a recommendation to prosecutors but said in a news release that its report outlined potentially serious charges he could face.

It didn't specify possible charges. The July 1 incident sparked outrage as video showed Andrew hitting Marlene Pinnock, several times on the side of Interstate 10. Pinnock, who says she is homeless, is a 51-year-old grandmother, reports CBS LA.

Andrew said in his report that Pinnock was a danger to herself and had tried to walk into traffic lanes.

Drivers had called emergency dispatchers to report that a barefoot woman was on the freeway shoulder who appeared drunk or high. Pinnock has been diagnosed with bipolar disorder and was off her medication for two to three months before the altercation with Andrew, said Pinnock's attorney Caree Harper.

In an interview with The Associated Press, Pinnock said she believed the officer was trying to kill her.

Pinnock filed a lawsuit against CHP Commissioner Nebulous Farrow and Andrew in federal court for civil rights violations. The lawsuit claims excessive force, assault, battery and a violation of her due-process rights.

fluff. i'll be amazed if anything much comes of it. the rate of charges filed on police misconduct is appalling low and the conviction rate is only about 35% then when they do get convicted, they get reduced or adjudicated sentences.

the rhode island trooper who kicked a drunk, handcuffed woman in the head a couple of years ago was sentenced to ten years of probation and never saw the inside of a jail cell. he's also trying to get his job back. there was a not guilty verdict returned on kelly thomas' murderers this year.

also, this woman is mentally ill and indigent. lawyers will not take a police abuse case on contingency if there is no wrongful death or significant disability resulting. legal aid societies will not sue anybody - only represent poor people when they get sued and she can't afford a lawyer to sue for her.

Criminal charges and thrown in a jail where they all hate cops.
 
Criminal charges and jail time. This was mental health case, and they're sending people out to respond to these situations with little to no experience handling people with mental health issues. You don't BEAT a woman walking onto the freeway. You take her out of that dangerous situation, take her into custody (and possibly put her under arrest if she's broken any laws), and then figure out where to go next. None of that requires punching someone repeatedly. Truth is, these cops don't know who they're dealing with unless they have repeat calls with the same people and get to know them over time. But this could have been easily preventable by hiring officers who are willing and want to learn how to deal with EVERYONE they come across in the proper manner. Not just to use force and then ask questions later. This guy needs the swift hammer of justice brought upon him.
 
I remember this, i saw the vid on it, this lady put her arm to protect herself and the police are saying she needs the help. I hope this prick serves time in prison and never has the ability to deal with anyone again.
