WASHINGTON — Republican senators joined Democrats in passing the biggest gun safety package in three decades, delivering a rare moment of bipartisanship on a politically divisive issue and a much-needed win for President Joe Biden.

The bill's passage was a massive shift in a Republican Party that has always been a firewall against any attempts to restrict gun rights. But the gun deal's lead GOP negotiator, Sen. John Cornyn of Texas, said the legislation saves lives without infringing upon Second Amendment rights.

Sen. Chris Murphy of Connecticut, the lead negotiator for the Democrats, has been fighting for reform since the mass shooting at Newtown elementary school in December 2012. His efforts were renewed last month after a mass shooting at a Uvalde, Texas, elementary school prompted him to call on his colleagues from the Senate floor: "What are we doing?" he asked during a widely shared speech.

Senators ultimately passed the Bipartisan Safer Communities Act 65-33 Thursday night after nearly two months of passionate floor debates, poignant hearings and the influence of actor Matthew McConaughey. The deal is now headed to the House, where it is expected to pass, despite House GOP leaders encouraging their members to vote against it.

However, Republican Rep. Tony Gonzales, who represents Uvalde, Texas, said he will vote in favor of the legislation. "As a Congressman it's my duty to pass laws that never infringe on the Constitution while protecting the lives of the innocent," he said in a statement Wednesday. "In the coming days I look forward to voting YES on the Bipartisan Safer Communities Act."

Even without a single GOP representative, House Democrats have a majority to pass the bill without Republican support and send it to Biden. It's a development the president can tout as an accomplishment at a time when his poll numbers are sinking, as Americans grow more frustrated with inflation and dismal economic forecasts.
 

 

 
None of it will stand, did they not see the latest rulings from the Supreme Court. Either someone will take it straight to court or someone will have their guns taken away without trial and Supreme Court here we come.

Yeah and they still passed it 65-33 in the Senate, so chances are it would pass constitutional muster.

Remember, Justice Scalia in Heller said that while there is an individual right to own firearms, there were limits: felons and the mentally ill can't own firearms, nor can legal resident aliens.

I have little doubt, the Supreme Court has made it abundantly clear you can not restrict people when it comes to the 2nd amendment and that’s what this bill is. So get it passed so they can get it made unconstitutional and we won’t see another attempt in my lifetime.

Take it with Justice Scalia; Heller was his decision (quoting the relevant part)....
“Like most rights, the right secured by the Second Amendment right is not unlimited…. [It is] not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose.”

The quotation—holding that the right to a gun is not absolute—is directly from that same Heller decision that Senator Cruz commends, written by Justice Scalia.

In fact, in Heller, Scalia went on to specify several types of Constitutionally permissible restrictions: “For example, concealed weapons prohibitions have been upheld under the [Second] Amendment [and there is no] doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms.”
This was confirmed about a decade later in Gamble v United States when the Court confirmed Scalia's decision the upholding the prohibition on felony possession of firearms.

You can post whatever you want but the Supreme Court will not let it stand. The first time someone has their guns confiscated without due process through the Justice system and it goes to the Supreme Court it will be the end of the law. The courts will not allow confiscation without due process period!

If the court is consistent they will, I don’t think you have been paying attention to their rulings of the past decade. It won’t stand.

You must be reading something else. No Supreme Court is going to allow a amendment right to be taken away without due process in the courts. And that’s what a red flag law is a bypass of the constitution. It’s not a question of will it be reversed, it’s a question of how long will it take to get to the Supreme Court.
 
No, that would be you; have you even read Heller?
Yes, besides it being completely different issue in the gun world this court believes in a strong 2nd amendment. And again courts aren’t not going to allow right taken away without going through the entire Justice system. It’s just a slippery slope for other rights to be abused. Courts will not let it stand, guaranteed.
 
And yet, as Justice Scalia pointed out in Heller, there are limits to it.
Of course there are limits, but this law they are trying to create crosses the line of those limits
