MARIETTA, Ga. (AP) — A man who says he got a traffic ticket for eating a cheeseburger while driving in metro Atlanta won't be prosecuted after all.

Cobb County Solicitor General Barry Morgan said in a written statement Friday that his office submitted a dismissal of the case against Madison Turner, and a judge signed it.

Morgan said the state didn't believe it had the evidence to prove the case beyond a reasonable doubt, given the facts and circumstances his office investigated.

Turner, who lives in Alabama, said he was enjoying a double quarter-pounder with cheese as he drove down a highway outside Atlanta when he was ticketed for violating Georgia's distracted driving law.

He said the officer told him, "You can't just go down the road eating a hamburger."

Thoughts? :burger:

He shouldn't have been ticketed anyway, I think. Its not like eating a cheeseburger necessarily involves looking anywhere but straight ahead. Its not a phone.

what's the difference?

i can talk on the phone and drive perfect...

but the thing is people are stupid and get distracted easily, especially if they're doing other things besides focusing on driving...

Talking maybe, texting is another thing.

Lol, unless there exists a law that forbids drivers not to do anything with their hands that could be distracting, I don't think he should've been charged with anything. You don't need your eyes to eat a cheeseburger, and I'm pretty sure you can do it with one hand.

i thought in the driver's manual that you should have both hands on the steering wheel? :|

people get distracted when doing other things too, i've witnessed it first hand...

just glad that he didn't cause a wreck...

:dontknow: You'd have to switch gears at some point so it can't be a hard requirement.

i think after you shift, if you have to, then back to the wheel with your hand? :|
