Should convicted inmates be entitled to half when they divorce?



A man was convicted of statutory rape and was sentenced to 30 years. He has decided to divorce his wife. And is demanding half of the marital assets. As the laws stand now he is indeed entitled to petition for half the marital assets.



What do you think, are prisoners of such convictions entitled to a ruling of half the marital assets? Should these laws be changed?
 
I know here in australia it's of up to half depending on how much work he did.

Ie, if he was the bread winner (money maker) and his wife was the household cleaner, and he went to work 5 days a week, and earned say $500/week. Whilst the wife worked to the equilivent of $600/week.

Assuming he just sat on his arse and expected his wife to do everything for him

Such a typical primitive man

Then he would only get up to 40%





On a personal basis, I think think he should even get 30% of what he asks
 
Even if he's in jail for another 25 years? What's he going to use the money for, really?

To be spiteful and vengeant. And also to have some money to do some more illegal activies with when he gets out of jail.

Fair enough. I suppose he is entitled to his money. What he does with it is not for us to judge. If it leads to more illegal activities, he'll probably just end back in jail..

I think it's a good idea but regarding the illegal activities after jail, that's up to the fellow.



He can use the money to survive should he be unable to find a job.
 
Okay, let me give a more real and serious answer.



If he lived with her and she had all those possessions before he went to jail, then yes, it's fair. He deserves his share, but a big part of dividing the assets is about the fact that they are what you are used to having (it's not easy to adjust to a new lifestyle, so you deserve some of what you are used to) and also it's some of what you earned.



If he never had it in the first place, though, then he doesn't deserve a dime.
