Should all crimes be equally punishable, or should circumstances decide the punishment?

It would be quite hypocritical to try a murderer at the same degree as a shoplifter...

Crimes should be punished based on severity and circumstance. There's no reasonable excuse for murder, so push that aside, but theft, drug-based crimes, that sort of thing should definitely be tiered.
 
I don't know where you got this idea but clearly each crime deserves its own penalty. I consider modern punishments to be very poor if we take into account some horrific crimes being done. I think that medieval torture should be allowed for some serious crimes.
